Terms and Conditions (T&C) for Rice & Carry Online Shop
1. Validity of the T&C
1.1. These Terms and Conditions (T&C) apply to all contracts concluded between the Rice & Carry Online Shop, Owner: GISA no. 36037742 - Susanne Berg, Palffygasse 10 in 1170 Vienna (hereinafter referred to as "Seller") and the customer (hereinafter referred to as "Buyer") via the Seller's online shop. The T&C in the version valid at the time of the order apply.
1.2. Deviating conditions of the Buyer are not recognized, unless the Seller expressly agrees to their validity in writin
2. Offer and Conclusion of Contract
2.1. The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding online catalog.
2.2. By clicking the button (analogously) "Complete order", the Buyer makes a binding offer to purchase the goods in the shopping cart.
2.3. The Seller confirms receipt of the order immediately by e-mail. This order confirmation does not yet constitute acceptance of the offer.
2.4. The contract is only concluded when the Seller accepts the Buyer's offer by an express order confirmation by e-mail or by sending the goods.
3. Prices and Payment Conditions
3.1. All prices in the online shop are final prices in EURO and include the statutory value added tax.
3.2. In addition to the stated prices, shipping costs may apply, which will be communicated to the Buyer before the order is completed.
3.3. Payment is made either by credit card, PayPal or instant transfer.
3.4. The purchase price is due immediately and payable without deduction, unless otherwise agreed.
4. Delivery and Shipping
4.1. Delivery is made to the delivery address specified by the Buyer.
4.2. Information on delivery times is non-binding, unless a binding delivery date has been agreed.
4.3. The Seller is entitled to make partial deliveries, insofar as this is reasonable for the Buyer.
4.4. The risk of accidental loss and accidental deterioration of the goods passes to the Buyer or a person designated by him upon handover.
5. Retention of Title
5.5 The goods remain the property of the Seller until full payment has been received.
6. Warranty
6.1. The statutory warranty provisions according to the ABGB and KSchG apply.
6.2. The Buyer must inspect the goods immediately upon receipt and report obvious defects to the Seller in writing within 7 days. Hidden defects must be reported immediately after their discovery. For return and/ or refund of the product it should be sent back to the Seller within 14 days.
7. Liability
7.1. The Seller is only liable for damages that are based on an intentional or grossly negligent breach of duty.
7.2. Liability for slight negligence is excluded, unless there is injury to life, body or health or a material contractual obligation has been violated.
8. Right of Withdrawal
8.1. Consumers have a right of withdrawal according to the statutory provisions. The cancellation policy will be communicated to the Buyer separately before the contract is concluded. The costs of the return shipment are borne by the Buyer.
9. Data Protection
9.1. The collection, processing and use of personal data takes place in compliance with the applicable data protection regulations. The Seller's privacy policy can be viewed on the website.
10. Final Provisions
10.1. The law of the Republic of Austria applies, excluding the UN Sales Convention.
10.2. If the Buyer is a merchant, a legal entity under public law or a special fund uner public law, the place of jurisdiction for all disputes arising from the contractual relationship is the Seller's registered office. Reference is made to the possibility of online dispute resolution (OS platform).
10.3. Should individual provisions of these T&C be or become ineffective, the effectiveness of the remaining provisions remains unaffected.
